The establishment and improvement of the national judicial assistance system for victims of criminal crimes are in line with the inevitable trend of strengthening the judicial protection of victims' human rights.To some extent,it has solved the survival dilemma of this special group trapped by the case,and increased judicial humanization and credibility.It has played a positive role in restoring social relations damaged by criminal ACTS and maintaining social harmony and stability.Due to the deviation of the concept,the absence of legislation and the system implementation,there are many problems in the operation of the national judicial assistance system for criminal victims in China.Including,The problems of repeated salvage and rejection of salvage application exist side by side,relief work aiming at solving the problem of complaint reporting,the continuity of work is poor,The overall standard of relief is lower,the problem of getting different relief insimilar cases is more common,lack of investigation and supervision mechanism,The connection mechanism between judicial relief and social relief is missing and so on.China's national judicial assistance for criminal victims needs to be improved in the system.By investigating the criminal victim relief system of major countries and regions outside the region,Some Suggestions are put forward to improve the national judicial assistance system for criminal victims in China:To establish a judicial assistance information sharing platform,to determine appropriate salvage subject,to establish the organ that initially accepts the application for salvage in the jurisdiction of the case is the competent salvage body,scientifically delimit the objects of assistance and set exclusions,increase the amount of salvage,to standard salvage standard,to improve the investigation and oversight mechanism,to establish a sound mechanism for connecting judicial assistance with social assistance,and so on.In this way,the system can better give play to the function of "emergency and disaster relief" and the value of "strengthening the protection of the right to subsistence",so as to convey the judicial temperature of the people.
