The Judicial Rescue System Of Criminal Victims In Our Country Is Perfected

For a long time,theory and practice of criminal justice in China is all about the criminal,and who in the spotlight is the criminal,while the victim keep figure.The criminal judiciary broadly think the best protection to the victim is to punish crime and protect society,instead of realizing the victim's hard from his position,and it causes the victim have to bear the consequences after being hurt.With the rise of the victim rights' movement,the criminal victims' rescue system enters people's view once again.As American professor Howard said in his book of Changing Lenses.A New Focus for Crime and Justice,said,we should regard Justice as recovery,rather than as a revenge.If crime is a kind of damage,justice should repair the damage and promote healing.If we want to promote the healing of victims' wound,we must fully protect the rights and interests of the victim and strengthen the relief of the victim,so the criminal victim's the perfection in the judicial assistance system being a hot issue of theoretical research and practical exploration.This paper includes six parts,the first introduction part introduces the research background and significance of this paper,also includes the existing research results at home and abroad and the difficult point and the innovation of this paper.The second part is a summary of judicial assistance system of criminal victims,mainly clarifies the connotation of the related concepts and,the system of historical origin and,the theoretical basis and value pursuit.The third part mainly aims at introducing legislation and experiences outside to our country criminal victims judicial assistance system,in order to improve our relevant legislation or practice for experience.The fourth part is to analyze the present situation of the judicial rescue system of criminal victims in China,summarizing the existing problems and discussing the causes of the problems.The fifth part puts forward the corresponding ideas for on the basis of the reality of our country improvement.Finally,the conclusion is the logical course of this paper,which indicates the viewpoint.
