These seemingly has become common sense, but when we think seriously about the answer, you will find all the basic answer from the media reports which are mostly one-sided and subjective.Respecting facts and abiding science are the principle for each study. This article attempts to investigate in such a manner by analyzing surrogacy,situation and the problems in the administration of justice, then put forward some suggestions in judicial judgments of surrogacy, in order to make some meaningful interpretation.The main ideas and framework of this article are as follows: firstly, set forth herein and willingness to inspire points. And then analyzes and demonstrate the problems of identified in our justice, including inadequate about application of law, identification methods and content. Finally, try to provide practical ideas for resolving the plight of the surrogacy justice in the presence vacancies of our current laws, including People-oriented(human dignity and rights) value judgments, method of integrity and individualized and appliance of legal principles.
