Study On The Legislative Regulation Of Surrogacy In China

A country and region can not lay up the establishment of high-level regulations for the practical needs for a long time but establish laws to prohibit or permit surrogacy with the considerations of its social realities.From the perspective of keeping society stable and protecting deals safe,The efficacy of ministry regulations from the Ministry of Public Health alone is too limited to regulate hidden surrogacy,causing a series of social problems without solution.With society develops further,moral and ethic standards restrict less,and infertile couples increase,demands on surrogacy will be in a formidable up going trend.It can be seen from the attitudes that every country has on surrogacy legislation that some countries or regions went through the process from total prohibition to limited allowance,which mirrors that laws and institutes gradually meet more and more social developing needs after countries and regions reflected the repetitive surrogacy even under continuous prohibition,and modified its laws.By combining the concrete situation of laws and regulations for surrogacy and the concrete legal issues in surrogacy,this thesis discusses and analyzes the legal workability of limited allowance to surrogacy from both theoretical and practical perspectives.And based on the practical demands and foundation,our country should adopt limited openness for surrogacy model,admit the legality of surrogacy within limited range,enact complete laws and regulations,and establish special surrogacy administration institute to supervise surrogacy.
