With the reconstruction of the global economic pattern, China started to develop FTZs in order to adapt to the new circumstances. Presently, four FTZs have been established:Shanghai, Guangdong, Tianjin and Fujian. The establishment of Shanghai FTZ and " abolition of some laws" authorized by the Standing Committee of the National People’s Congress resulted in some problems in law enforcement in China’s FTZs, including a lack of legal basis for law enforcement and defective law enforcement institutions. Consequently, the imperfection of the legal system and the institutional inadequacy and malfunction have brought about many problems in the areas of legislation, management and judicial institutions. Based on the analysis of the above problems and their causes,as well as the successful experience of FTZs abroad,this thesis tries to find solutions for solving the problems in legislation and institution-building in China’s FTZs.It is significant to handle well the relationship between local law national law and international law. The basic principles in the Legislation Law should be respected and the role of local legislature should be exerted without conflicting with higher-level laws. The legislative practice has produced comprehensive local laws and national laws regulating FTZs.However, there is still a long way to go before establishing a basic law for China’s FTZs. The re fore,trans forming of policies into laws can be the major work for formulating Chinese FTZ basic law. By summarizing some cases of FTZs in the world, this thesis analyzes the institutional experiences, which including the promotion policies forfree trade and freedom of finance and investment, and building a rational supervisory system. The issues of law application in FTZs are connected with the significant legal subject of the unity of the country under the rule of law in the process of role of law in China, which should be further studied.
