On The Administrative Guidance In Current Owners’Committee Elections

Since housing system has greatly changed as well as the obtaining way of housing property, the housing supply way is converted from "communities" to "society". People become owners by purchasing houses and then have the relationship either close or strange. However, Property Management Regulation provides that owners’meeting must be on the basis of the guidance of corresponding organization and that people elect owners’ committee to protect owner’s right. Therefore, it becomes law protection in restricting and balancing profits.In the process of electing owners’committee, the running of administrative guidance is not standard and lack of necessary law protection. The owner’s committee can not stand for all the owners’prospect so that the owners’profit is greatly damaged. It is becoming a major problem in influencing the country’s constructing and developing. Therefore, the government must face and solve the problem about how to make e owners’committee lection step away from the present social background and how to represent the legal rights and obligations.The thesis chooses a case that has universal effect to analyze the owners’committee election and the corresponding problems. In the perspective of law, the thesis also proves the relationship between administrative guidance and owners’committee and at last gives suggestions.The thesis is divided into four parts:Part One is an introduction which introduces the purpose, significance, contents and methods of the owners’committee election.Part Two is an overview of the owners’committee election and administrative guidance. Firstly, analyze the concept of owners’ committee and administrative guidance. Secondly, briefly introduce the owners’committee election and discuss the origin and development of the owners’committee. Finally, an overview of the legal basis of the owners’committee establishment and introduces the owners’committee election on the basis of democracy.Part Three is analyzing the status and reason in the owners’ committee election. First introduce the specific case, then according to which analyze the existing problem in the process of the election.Part Four is solving the problems of administrative guidance in the owners’committee election. Firstly, enhance the participation of owners in the election by the way of formulating administrative guidance and educating owners. Finally, achieve the active participation of owners by the way of enriching the e-government construction and making sure the corresponding administrative responsibility.
