A Study On The Identification Of Parentage Under Surrogacy In China

Family is the cell and footstone of harmony and stabilization of a society,sons and daughters, as a crucial part of family members, are closely related to the stabilization of families. Due to the restriction of objective conditions, some families could not have children through a natural way and this becomes a great pity in their lives. But surrogacy brings hope to those families and makes them possible to be parents. Surrogacy is controversial since it’s available because it breaks traditional ethics. Even today, surrogacy is not legal in many countries. Despite all this, surrogacy doesn’t disappear in China, on the contrary, it is applied secretly and this brings many tough problems at the same time, one of them is how to identify legal status of surrogate children.This paper is mainly composed of three parts. The first part is a brief overview of parentage identification of surrogate children under the background of surrogacy in Chinese society, then makes a fundamental exposition for surrogacy and discusses domestic and international legislative status of surrogacy. The second part is a careful analysis of theoretical models of parentage identification of surrogate children around the world. It investigates related foreign legalization and makes its own viewpoint on the parentage identification of surrogate children in China by breaking traditional rules. The third part makes advice on how to legalize the identification of parentage under surrogacy in China.
