With the continuous development of the economy, improved living standards, tourism became one of the main activities of daily consumption. The rise of tourism industry space is very large. However, due to the complexity of social relations, tourism disputes will appear frequently. At present, the various parts of the world for tourism consumers in the process of consumer rights infringement relief characteristics. At present, relevant departments in various areas of the wo r1d for tourism consumer rights and interests are harmed during the proce ss of tourism compensation have their own characteristics. Countries very pay attention to the communication between economy, culture and other fields, are on both sides of the Taiwan tourist destination, and constantly i n recent years on both sides. This paper adopts comparative research method to make an analysis of Taiwan and the mainland area of the protection of consumers’ rights and interests, summarizes the advantages and disadvantages of both, and suggest to improve according to the present situation of the mainland area of tourism consumers’rights and interests protection.This paper is divided into five parts:The first part:mainly elaborates the content of tourism consumers’ rights and basic problems related to the classification of tourism consumer disputes. The second part:mainly expounds of cross-strait tourism consumers’ rights and interests protection mechanism from the aspects of administrative management and civil organizations. The third part:introduces the content of the tourism consumer protection from the cross-strait tourism consumer. The fourth part:mainly introduces about tourism consumers’ rights protection relief way from the aspects of tourism disputes solution. The fifth part:the paper points out the problems existing in the tourism consumers’ rights protection in mainland area and makes an analysis of existed problems.In this paper, the author puts forward suggestions in the last part, China attaches great importance to the development of tourism industry, mainland area must be practical and improve the system of tourist complaints on the basis of "tourism law", At the same time, departments should give full play to the role of non-governmental organizations and improve the efficiency of tourism dispute resolution, which guarantee tourism consumers’ rights better than before.
