Study On Standardization Of Comprehensive Administrative Law Enforcement Of Urban Management In A Rule Of Law Government

Since the 18th CPC National Congress, as a significant task of the government, Constructing of Rule of Law is involved in all parts of country governance. Urban management, which is an important and difficult part of administration area, not only relates with the living condition of all the citizen, but also has great impact on the constructing of a Rule of Law Government for China. The Comprehensive Administrative Law Enforcement of urban management has made a progress such as changing the situation of duplicate and inefficient law enforcement since the concentrated administrative power of penalty was carried out. Still, it is criticized because of uncivilized behavior, ignoring legal procedure and some other reasons from time to time. Therefore, with the background of construction of a Rule of Law Government, it’s worthy paying enough attention on solving those problems of standardization of comprehensive law enforcement with a thinking method of ruling of law.This article starts with theory of Rule of Law Government and Comprehensive Law Enforcement of urban management which includes concept and characteristics of Rule of Law Government and its development, origin of power of Urban Management Comprehensive Law Enforcement and the range of it. And then, conclude the goals need to be achieved during the standardization of comprehensive law enforcement according to requirements of rule of law government.The second part of the main body of this article points out those nonstandard phenomena of comprehensive law enforcement such as ignoring legal procedure, acting rudely, illegally abuse of power and so on. Further, reasons for these nonstandard phenomena from the viewpoint of law-executor and the legislation are figured out.At last, basic on the theory and analysis above, this article gives some advice from the aspect of legislation, law-executor team building, construction of system for responsibility and supervision in order to offer some reference for the current comprehensive law enforcement in our country.
