The Research Of Litigation Protection System Of The Anti Dilution Trademark

With the rapid development of China’s economy, social progress, the size of the goods and services industry continues to expand, but also a variety of forms, people are more inclined to pursue higher quality and better credit products and services. And with a well-known trademark goods are more susceptible to be consumers, but also to some ulterior motive of businesses in order to expand sales and "free ride" opportunities, with well-known trademarks approximate or similar trademarks in the same or not those goods. That created a demand for well-known trademark dilution. The authors therefore consider it necessary to dilute the trademark infringement separate legislation to protect so well-known trademark ownership proceedings are able to protect their legitimate rights and interests through legal means. Taking into account the present stage of trademark dilution protection system is not perfect situation. This article aims to analyze suability basis of trademark dilution above, combined with the foreign can learn from it in practice and on the legislation of our country. We made recommendations to improve trademark protection.
