OBERGEFELL ET AL. v. HODGES is a case of legalizing gay marriage landmark case in the United States, opening a new chapter in the field of human marriage. In the framework of history, the author studies the manner of case and analysis the judgment, studied the Development of American same-sex marriage, and analyzed from the perspective of law changes and examine the theoretical basis of the concepts behind the dispute.This article includes the introduction and the body of two parts. The introduction describes the motivation for writing and meaning, and summarizes the current research, the last part introduces the source of the materials briefly.The first part is related to define the concept. The author introduce the traditional concept of marriage and the concept of modern marriage, in addition, it describes the same-sex marriage in three different ways, which reflects the US development of gay marriage.The second part of the body is to show the a focus of controversy. First, we discuss the core elements of the modern concept of marriage, and secondly, the author presents the opinions of the Majority and the Opposition. It is about the Principles of equal rights and Due Process. At last, the author show the opinions of herself.The third part of the text discusses the significance of legalizing same-sex marriage from gay individuals, children, marriage, and social perspective. Finally, in conclusion, the author gives a brief summary of the appeal. If everybody can be a little more tolerant, a little more calm, pluralistic world will remain good. |
