Legislation Of Alien Invasive Species Prevention

Along with the rapid increase of international communication, a large number of species had invaded due to the lack of rational thinking when alien species were introduced. This causes economic loss and damage to native biodiversity. It leads to the cost of hundreds of millions yuan every year in China. However, there are no related measures for the prevention and control of alien species invasion in our country. The invasion of alien species is a new environmental problem. The country need to prevent invading at law level. Our prevention and treatment legislation of invasive species mainly includes local regulations and profile control laws and regulations. The invasion of alien species in our country is serious, and the existing legal means could not handle with this. The legislation of preventing and controlling alien species invasion can carry out the national policy of environmental construction in China, realize the harmonious development of man and nature, it can also contribute to the social stability.Based on this, this article embarks from the actual situation of alien species invasion in our country, elaborates the legislation in prevention and control of alien species invasion through the related theory, and puts forward the legislative ideas. In this paper, we study the basic ideas of the law on the prophylaxis and control of alien species invasion and the specific legal system, legal responsibility content. In addition to the introduction, they are divided into the following four parts:First of all, this paper introduces the concept and characteristics of alien species invasion, recognizes the basic characteristics of alien species invasion, and give an overview of law, administrative regulations and local regulations in prevention and control of alien species invasion in our country. Secondly, this paper summarizes the existing laws and regulations to deal with the harm of alien species invasion, puts forward necessity and feasibility of setting up a nationwide prevention and control of alien species invasion legislation. Thirdly, this paper introduces advanced legislative ideas, updates the prevention and control of traditional legal thought of our country by referring to the introduction of the interagency management system in United States, national strategy for prevention and control alien species invasion of Canada, public education system in Argentina, strict inspection and quarantine system of Australia and New Zealand and the Japanese classification system of alien species invasion. Finally, this paper establishes our prevention and control law of alien species invasion according to the current conditions of our countryThe legislation purpose of our country’s invasive species prevention law is to ensure the ecological security and development of social economy, and the legislative scope changes from the traditional people’s interests first extended to ecological security. This law can formulate the principles of combination of prevention and treatment, public participation and coordination. At the same time, it develops a legal system which includes invasive species hierarchies, environmental risk early warning, animal and plant quarantining, introduction to declare for examination and approval of science, public education and the emergency warning monitoring of invasion, intrusion tracking clear after the legal system of ecological restoration. In order to ensure the effectiveness of preventing alien species invasion, it is necessary to investigate the legal responsibility of the relevant responsible person in accordance with the different circumstances, and to establish the civil, administrative and criminal legal liability system. To implement the prevention and control of alien species work in our country, this paper argues that China needs to develop national legislation for the prevention and control of alien species invasion.
