A Study On The Invasive Alien Species Legislation Of China

The invasion of alien species, not only does harm to biodiversity and ecologicalbalance, but also blocks the development of the society, expecially, it will have bad impact onhuman health. As early as in the1950s, the invasion of alien species problem had attractedthe attention of the relevant countries and regions. In Rio de Janeiro in1992, after the UnitedNations Conference on Environment and Development, the invasion of alien species hadaroused widespread concern worldwide, and related organizations had begun to take specificactions. Relevant international actions has promoted the awareness of our country to alienspecies invasion, and gradually our country has begun to take the necessary measures to buildlaws and regulations. However, there are not any perfect legislation in prevention and controlof alien species invasion for our country now. The absence of the legal system, will inevitablylead to slow actions. Compared with countries with well-developed legislation, it is urgent tobuild a perfect legislation depended on China’s national conditions. Therefore, to gain usefulexperiences for our country by studying the achievements of international community as wellas legislations to combat the invasion of alien species of foreign countries is the effectivemethod to speed up relevant legislation’s building, and thereby enabling the control oninvasion of alien species into the canonical and legal track. The thesis includes the followingpoints:Specify the notion of invasion of alien species. Combined with the internationalconventions and foreign legislation, firstly, to explain the legal meaning of the alien speciesand the invasion of alien species; Secondly, to analyze the relationship between the invasionof alien species and biological invasions, and the differences between the concepts, to ensurethe preciseness of the prevention of alien species invasion law.Propose the ideas of fighting against the invasion of alien species for our country.Respectively, present the legislation basis of our fight against the invasion of alien speciesfrom the view of theoretical basis, necessity and feasibility of legislation.Introduce and analyze the development conditions and experiences of the preventionand control of alien species invasion in international legislation. Firstly, to introduce therelevant international conventions and the combat of relevant international organizations. Secondly, to introduce the legal system of the European Union, other European countries, theUnited States, Japan and other countries and analyze the remarkable achievements in thelegal system of these countries in the prevention and treatment of invasive alien species, andsummarize their experiences. Finally, to propose the revelation of legislation to fightingagainst the invasion of alien species based on these legislation and practise.Present suggestions combined with the useful experiences of foreign countries and theimpact of invasion of alien species to our country.
