The Primary Exploration Of The Environment Public Litigation In China

It is important to improve the public participation in the environmental monitoring through the environmental public interest litigation.This paper analyzes the defects of the traditional environmental protection law and the traditional civil procedure law in the environmental protection,and gets a new conclusion that is a very realistic and necessary work to build a new system of environmental public interest litigation.After reviewed the effect of environmental public interest litigation by some local government,we check about the provisions of new civil procedure law and new environmental law and some of the rules and theories from abroad,and give a new general rules of environment public interest litigation.
