The Electronic Contract Legal Effect Under The Mode Of B2C

Online shopping is a very popular way of shopping, in the field of contract law to see the online shopping, is in the network environment to complete the sale contract(electronic contract) signed. Electronic contract is different from the traditional sale contract, but also by the basic principle of contract law. Electronic contract is the core part of the whole e-commerce activity, its legal effect is related to the whole process of electronic commerce. In this paper, the research on the domestic electric business platform of several major B2 C, the form and the legal effect of the transaction mode, the electronic contract and the legal effect of the contract law of our country is put forward.The first chapter of this paper mainly analyzes the social background and practical significance of the research, through the study of the present situation and the status quo of the domestic and foreign legislation, to better grasp the depth and breadth of the research. The second chapter focuses on the electronic contracts involved in the B2 C model. By defining the concept of electronic contract, it will help to better grasp the direction of this subject. The third chapter studies the influence of the contract form to the electronic contract validity. Through the form of contract, contract signature and the original contract has carried on the analysis to the influence on the validity of the contract, study how to according to current legislation, standardize the legal effect of electronic contract. The fourth chapter studies the effectiveness of the contracting party and the electronic contract. Focus on the analysis of the ability of the Internet users and the business platform and the merchant’s ability to influence the effectiveness of the electronic contract. In the fifth chapter, the effect of the defect on the electronic contract is studied. In this chapter, we will sum up the situation of several kinds of electronic means, which can be caused by objective reasons, because of the influence of the electronic means that the defect of the contract is the legal effect of the contract. The sixth chapter mainly studies the legal effect of electronic format contract. Through the analysis of the contract of electronic form, contract content and the effect of the electronic contract user ’s obligations, the research on how to regulate the electronic form contract is studied.
