| The people’s assessors selection mechanism is an important part of the assessors system. The assessors system of our country was hard established, which was combined the painstaking effort of countless men of law and has obtained brilliant achievements. However, there are still many problems in practices. In this essay, the people’s assessors selection mechanism of China will be studied in depth.This paper is divided into three parts. The main content of each part as follows:The first part focuses on the evolution and current situation of the people’s assessors selection mechanism of China and the development of selection mechanism of China in different historical periods. And then the legislative regulation of the current assessors selection mechanism will be discussed and analyzed. Finally, the implementation of results of the current assessors selection mechanism will be presented.The second part focuses on the problems which existed in the actual operation of the people’s assessors selection mechanism. Such as high elective conditions, elective mode confusion, elective procedures are not standardized, the term is too long, etc.Moreover, the reasons of these problems will be explored and the negative impact of them will be revealed.The third part is the last and most important part of this essay. It focuses on solving the problems which arose on the second part of this paper. There are three main aspects to improve. One is reasonably determining selection conditions of assessors and eliminating situations of assessors selection should be detailing. Second is developing the process of selection, like improving methods, main body, grading system. Third is adjusting term of office. |
