A Study On The Legal Liability Of The Master

A master is the chief commander in marine transportation and plays a decisive role, but the research for the master’s legal status and liability are not keeping up with the development trend, over time it will not be conducive for our country’s shipping industry.Taking the master in the Maritime Code as the research object in this dissertation, it discuss the multiple legal status of the master in the perspective of both the public law and the private law, contains the powers, the rights and the obligations, and then analyzes the master’s legal liability in the shipping process from the perspectives of civil, administrative and criminal field.There is no consummate legal system for master’s criminal liability in our country’s law, so it is emphasized in this dissertation, the paper analysis the shortcomings of the existing law and put forward the perfect suggestions.
