In Modern Society, mental health problemis not only a major public health issue, but also a relatively prominent social problem.Mental Health Law of People’s Republic of Chinawhich comes into force since May 1, 2013 is the first law in the field of mental health, andon the basis of voluntary principle, the Lawhas establishedinvoluntary treatment system of people with mental disorders. This paper describes our laws and regulations on involuntary treatment system of people with mental disorderscombined with our real-life situation of mental health and the practice of the past, argues that involuntary treatment system of people with mental disordersstill fails to avoid the abuse of guardianship, executive power, diagnosis right and admissionright of the medical institutions and physicians. Therefore, under the premise of involuntary treatment system of people with mental disorders from abroad, the paper proposes to uphold the principle of procedural justice and the principle ofbest interests of people with mental disorders to improve ourinvoluntary treatment system, in order to better balance the relationship betweenindividual rights of people withmental disorders and public safety, public order.
