| Shanghai French concession lasted hundred years, with the grate change of the history, the trial institution changed repeatedly. The Second District Court of Jiangsu Shanghai in French concession & the third branch of the High Court which was his appeal court were setted up simultaneously on the first day of October in 1931.From then,the court in French concession had normally become Chinese legal system,using Chinese law to deal the cases. Until the 1939 March,Shanghai special mayor Fu Xiaoan of Reform Government upheld the Japanese’s command that was withdrawing the Special District Court. At the same time, Reform Government stated that civil and criminal judgments were totally null from the April 1939.But,the French Concession Authority didn’t care with it, removing the Court site to Shanghai International Settlement and continuing the adjudgement, After the Vesey Government surrendered to Germany, the Authority tore up the agreement unilaterally, allowing the Reform Government takes over the Court, Sun Shaokang became dean. From then, the independent trial had been finished temporarily.In the beginning of 1940, after two years’ war, the materials were poor with inflation, becoming the challenge to normal people’ living. Despite this, the drug was still difficult to eradicate like opium and morphine, etc. Addicts who smoked drugs treated it as mental and physiological food, and could not give up. In this way, it was harder to stop people’s yearn to fortune interest. The Profiteers transported drugs for sale and setted drug house for smoking. The young guys became dudes to help other people sale, transport drug or set up drug smoking house. Because of the severability and portability of the drug, most of the addict hid the drug in the inner of the cloth, when they went outside. And at home, they usually hid it in shelter, like bed, low floor, pen case, etc. It can be clearly seen that the criminal behavior is hidden.As the case of the Second District Court of Jiangsu Shanghai, drug case was the one with high incidence, which had distinctive characteristics of the times, citing the special law about drug. Although the day of drug had gone, our research on drug cases basing the archives can be a reference to nowadays investigation, trial and prevention of drug cases.The article has six parts, the introduction and five chapters.The introduction includes the significance, the reason, the academic history and the research methods of the drug cases. The academic history part discusses the academic results on drug case and the lack of research result, then tells the article will be more meticulous, expanding the vision of criminal research of the French Concession.The first chapter describes the drug crime of French Concession. Firstly, introducing the drug and summary of drug crime. Secondly, analyzing the elements of drug crime, including the subject of the crime and subjective and objective condition.The second chapter describes the detection of drug crime of Shanghai French Concession. From the institution and man of detection, to the methods of detection.The third chapter discusses the trial of the First Court, trying to reduce the origin of the court. Firstly, we introduce the personnel involved in the trial, the methods of appraisal,proceedings,joinder and results.Then,discussing the trial basis of drug cases.At last,describing the discretion of judge.The fourth chapter studies the appeal procedure and execute program of drug cases,and Security Measures of the case.It includes phenomenons in the procedures and cause of them.The final chapter considers the other questions about the drug cases. Firstly, it studies the feature and experience of these cases. Through the chapter’s analysis,we can know more about the content of the thesis.Conclusion is the summary of main body’s five chapters. |
