International Legal Issue Of Air Defense Identification Zone

The United States of America is the first country to designate Air Defense Identification Zone(ADIZ). America has always been the advocate and leader of Air Defense Identification Zone system, and the present ADIZs of most countries are modeled on that of America’s.Developed for over 60 years and practiced by over 20 countries, ADIZ has been acknowledged by many countries.However, ADIZ is a sovereign state’s airspace designated on its adjacent international airspace,this leads to a number of international legal issues.The first part briefly introduces the origins and status quo of ADIZ, and then analyzes the reasons why the international legal disputes arise and ADIZ mainly caused three international legal issues.The second part mainly discusses the issue of jurisdiction, with the development of science and technology, states under the old system have been unable to guarantee its security, so the states had to create a new system to adapt to the new reality. Secondly, the article lists two practices that is similar to the ADIZ.Thirdly,the practice of ADIZ is actually the Pre-exercise of Self-defense.The third part mainly discusses the freedom of overflight.The freedom is not an abstract concept.The validity for the Air Defense Identification Zone to limit freedom of overflight on seas comes from the fact that it is not prohibited by international law.The fourth part mainly discusses the regulations of the Air Defense Identification Zone of the East China Sea and the suggestions about it.
