Analysis Of Air Defense Identification Zone System

The establishment of the East China Sea Air Defense Identification Zone has raised controversy over its legality soon after the official announcement of the establishment and the announcement of the aircraft identification rules. Generally speaking, there is no accurate law or treaty has jurisdiction right over legal status or operational rules of ADIZ. And that lead to many controversies on dividing, establishment and operation of ADIZ.In fact, ADIZ is a product of history, it has been exist for years, and has already become a system that accepted by many counties. No doubt ADIZ system is subject to customary international laws. In this thesis, we could know the history and function of ADIZ; analyze that actually costal states has right to establish ADIZ and set rules ADIZ rules under the guidance of international conventions; analyze legal status of ADIZ from the aspect of international law; and to conclude that China has legal right and grounds to establish its own ADIZ and that does not against the spirits of international law and it is necessary to perfect the ADIZ system.
