Investigation And Study On The Problem Of Agricultural Subsidies Implementation

With the increasing strength of China’s economic and the continuous improvement of the level of economic, our country pays more and more attention to the agriculture, especially, in the 21 st century, agricultural comprehensive production capacity increased significantly in our country, but we also face prominent problems, such as agricultural infrastructures are still lagging behind, the farmers’ income is still low, a large number of young rural labors are transferred to cities, agricultural labors are not enough obviously, what’s important is the efficiency of agricultural subsidies is falling instead of rising which has been enforced for many years in China. Whether the current situation of agriculture can affect the basic status of agriculture, and even threaten the food security of the country or not? This is a question worth of considering and exploring.From the legal Point of view, the reason about the existence of problem is the imbalance of related rights and obligations between subjects, and the way to solve the problem is to improve the related legal systems so that make a balance between subjects of balance and coordination. The purpose, from the aspect of law, of looking into the legal system that related to implementation of agricultural subsidies and policy is to look into the legal system related to agricultural subsidies and implement of policy, to investigate that whether the implementation of the agricultural subsidies achieve the intentions and purposes of the legislation, or to research the implementation effect about the system of agricultural subsidies and policy. To investigate and study the problems of the agricultural subsidies implementation is to evaluate effect of agricultural subsidies through the investigation materials. The author thinks that we can study the main problems of agricultural subsidies implementation from the following three aspects: firstly, to investigate whether the function and purpose of implementation is achieved or not; secondly, to investigate whether The central people’s government of china or local government and agricultural procreators perform and comply with the agricultural subsidy obligations stipulated in the relevant laws and policies; thirdly, to investigate the degree of division the agricultural subsidies cause in natural and market risk to farmers.To make a summary, the author thinks that there are three problems exists in agricultural subsidies, the first one is the goal of agricultural subsidies is not clear, the second one is the lack of government’s support of agricultural subsidies, the third one is the agricultural subsidies can not reduce the risk of farmers to plant effectively and reasonably. The reason are three, the first one is that the legal system of agricultural subsidies does not deal with the relationship between government and market, the second one is that agricultural subsidy legal system does not deal with the central-local relations, the third one is that the relevant laws and policies to reduce the risk of farmers to plant is imperfect. So, to improve the legal system of agricultural subsidies, we should make the relationships harmonious between central and local, the government and the market, and perfect the subsidy measures of reducing the risk of farmers, strengthen the supervision of agricultural subsidies, etc. Key words: agricultural subsidies; government; market; grain farmersEssentially, in this paper the author tries to research the problem of agricultural subsidies from three aspects, the first is the disposition of rights in agricultural subsidy between central and local government, the second is the disposition of rights between the government and the market, the third is the disposition of rights between farmers and farmers, especially the ones are engaged in agriculture. Because of agricultural subsidy fund investment includes the central government investment and local government investment, this is related to which government could be more reasonable in agriculture investment, and the will to invest in agriculture in local government, and wether local governments have misappropriated funds for agricultural subsidies or not. In order to realizing the purpose and function of agricultural subsidies, legal system should appropriately deal with relationships between government and the market, for the market that the market can regulate better, the government should interpose as little as possible even not interpose.The degree to the farmers’ understanding of agricultural subsidies is the prerequisite for rights and interests of subsidies, to advocate their legitimate rights and interests is related to the issues of fairness and justice, and give a reasonable protection to farmers’ income of grain, prevent the cheat behaviors in agricultural subsidies, these problems are related to fairness and justice. Therefore, the author mainly researches the agricultural subsidies implementation issues from three aspects, to find out the main problems existing in the implementation of agricultural subsidies in China and analyze the legal reasons existing in agricultural subsidies, and finally puts forward suggestions and measures to improve the legal system of agricultural subsidies, so that to realize the disposition of rights and obligations between related subjects and improve the outstanding problems agricultural industry is facing and promote the sustained and healthy development of the agricultural industry.
