Study On Legislation Of Financial Leasing In FTZ

Financial leasing is the highlighter of China’s FTZ.Currently the overall scheme of four FTZ have a series of financial leasing policy breakthrough,such as lower the threshold market access, broaden business scope, tax incentives, etc.Although it is possible to stimulate the development of financial leasing in China’s FTZ in a short time, the innovations can’t change the legislation of financial leasing.At present, financial leasing in China’s FTZ still exist the following problems:different regulation standards lead to imbalance development of financial leasing companies;lacks good social credit environment results in more and more breach of contract;lower legal basis and lack of accessory institution,etc.These problems seriously hindered the development of financial leasing,it doesn’t meet a “Investment Facilitation”and “Trade Liberalization” and “Open and Transparent Market”of China’s FTZ.Based on this,the paper find out the situation of financial leasing in China’s FTZ and the cause of situation by sorting out relevant law and policy of financial leasing in China’s FTZ.Based on using the experience of other countries for reference,make suggestions to the development of financial leasing in China’s FTZ.The paper includes five part.First chapter is introduction.This part introduces the research background and significance,literature review,research methods of the paper.Second chapter is summary of financial leasing of China’s FTZ.This part defines FTZ,FTA,financial leasing.And it states the significant of the development of financial leasing in China’s FTZ that promoting technology and upgrading industrial, supporting the development of small businesses,promoting foreign trade.And it points out that financial leasing in China’s FTZ is confronted with some problems such that lack of innovation,imbalance development of financial leasing companies, the poor credit environment,etc.Third chapter is the legal problems of the development of financial leasing in China’s FTZ.This part find out the legal problems that lower legal basis,different regulation standards,and lack of accessory institution by sorting out relevant law and policy of financial leasing in China.These problems hinder the development of financial leasing in China’s FTZ.Forth chapter is the experience of other countries for reference.This part introduces the experience of financial leasing in America,Germany,Japan,and refines inspiration from them for developing financial leasing in China’s FTZ.Fifth chapter is the innovation of legal system in China’s FTZ.On the basis of the forth chapter,it give advice for the existing problems noted in the third chapter that open the financial leasing market, uniform the rule of supervision,improve the relevant accessory institution,higher the legal basis in China’s FTZ.
