Research On Objects In National Relief System For Criminal Victims

In criminal theory and practice, we focus on publishing criminals. The criminal law in China is centered on the criminal,and the victim was always forgotten by the people. In the prosecution, the victim has fewer rights compared to the the defendant. The victim may have compensation through the litigation, but in many cases, the victim got nothing because of the economic problem of the criminal. Some victims felt unfair and despaired,and some even attacked others.In recent years, the necessity and feasibility of establishing national compensation system for criminal victim is the hot point of view.Some provinces and cities in China have actively carried out the practice of the relief system for victims.The system has experienced some stages, from local practice to local legislation.In 2014, the national document was published. But there are many inevitable defects in the process of practice.This paper uses the method of comparative analysis.The first part of the article introduces domestic instances of victims’ relief work.The second part of the article mainly introduces the present objects in international and domestic instances of victims’ relief work. There are many problems in our work.The final part of the article discusses that how to perfect the regulations of objects in criminal victims’ relief system from the domestic conditions. The relevant factors involved are divided into two categories, one is about conditions of victims, the other is about the limiting conditions of objects.
