Labor right is an important content of human rights. The definition of hired civil servants is that who meets the conditions have the right to candidates the position and obtain the payment. These rights mainly includes the right of choosing occupation, being employed equally, obtaining the payment, making sure the work environment safety and having the opportunity of working training. In order to discuss the existing problems and the legal protection measures of the hired civil servants, the paper take the hired civil servants as the breakthrough point. The hired civil servants possess independent thought and various needs. They exercise the power on behalf the state.Therefore, we should not pay attention to their management,but also to protect their rights. We can’t imagine that a person can provide a high quality service for others while his own right without guarantee. Further, the protection of their rights is helpful for the construction and social progress. The paper analyze the present situation of the labor right of the hired civil servant, judging their pros and cons.Then, on the premise of them,putting forward the measures to protect the hired civil servant labor rights. To update the traditional concept of protecting the right of the civil servants. To perfect the related protection system, including supplements and modifications.To focus the related legislation and refining the law in view of the actual situation. Making sure these measures are more operable.At the same time,paying attention to the independence and authority of relief agencies. Eventually, according to the fact of China, setting up a corresponding institutions and mechanisms.
