Our mining right legislation existed since ancient time. However, it was not noticed and developed specific until the late Q ing Dynasty. But the thought of mining right legislation had already been in bud. Especially, it was embodied specifically in Qing Dynasty. Overall, the mining right legislation in the end of Q ing Dynasty played a significant role in promoting the process of mining right law in our country.Beginning from the concept of “mining right”, the formation process was discussed, using the methods of historical research and comparative analysis. And then a concrete analysis was made about the specific legal system and provision which was made in the end of Q ing Dynasty. Based on social background and abroad, the following aspects were mainly researched:Firstly, from the cause, the development and the result of the mining right recovery movement, the promoting function on mining right legislation was discussed. Secondly, Germany and Japan already had a more reasonable and complete mining laws and regulation system for reference at the same time, in order to explore the influence on the development of legislation, a comparative analysis was made. Thirdly, focused on some specific le gislation, the legal thought and implication of jurisprudence behind were explored. Fourthly, the impact of mining right legislation in the end of Q ing Dynasty to the Republic of C hina was evaluated, and the historical significance and limitations of mining right legal system was studied. Through the research of this paper, we can deeply understand the essence about the mining legislation in the end of Q ing Dynasty, and learn from history to develop the present.
