Our country formally entered in the aging society in 1999, and into the accelerated aging period. By 2014, China’s population aged 60 or older reached 200 million, and will exceed 300 million in 2025. Social pension issue has become a problem the people and the government most concerned about. All along, our pension insurance system is not the same as the urban and the rural, Which led to a further widening of social injustice. The State Council promulgated the opinion "on the establishment of a unified basic insurance system for old-aged urban and rural residents " in February 21,2014. Began to implement a unified basic old-aged insurance system for the country’s urban and rural residents, which was a milestone for the history of the development of China’s social pension insurance. It can help to accelerate the pace of urban and rural social security co-ordination, narrow the gap between urban and rural areas gradually, equal the basic public services. It also has an important role in stimulating consumption, encouraging innovation and entrepreneurship, promoting economic development. It also could help to improve the the people’s social security, to achieve social harmony and stability.China’s social pension insurance systems of the urban and the rural residents have been long relied on the policies and documents, never rose to the height of the law to regulate. It susceptible to the influence of the political, economic, and other social changes, lack of stability and sustainability. Although Social Insurance Law came into force from July 1,2011 established the basic framework of the social insurance system for the first time and a legal form of covering all urban and rural residents in the social security system, full the legislative gaps in social security. But Social Insurance Law is a comprehensive social insurance law, the norms in terms of basic pension insurance still seems too vague. Lagging pension legislation has affected the healthy development of pension insurance. The basic pension insurance of the old-aged urban and rural residents is an important part of China’s social security undertakings, Do intensive research on the legislation in the basic pension insurance of the old-aged urban and rural residents, and offer relevant legislative proposals, has great theoretical and practical significance to the healthy development of the basic pension insurance of the old-aged urban and rural residents. It also help to enhance the theorists’ attention on this issue and perfect the existing legal system theory of the social endowment insurance system. Provide a theoretical reference for the development of the pension insurance business in China and the entire social security undertakings.In this paper, author used a series of research methods such as combining theory and practice, historical research, comparative analysis and so on to study the basic pension insurance of the old-aged urban and rural residents. Using the method of historical research to card the development process of China’s urban and rural residents’ social pension insurance system. Do research on practical achievements and shortcomings which the urban and the rural residents’ social pension insurance achieved in through theoretical analysis, empirical analysis and comparative analysis. Analyze the necessity and feasibility of the basic pension insurance of the old-aged urban and rural residents. Finally concluded that the current legislation can be selected by the State Council administrative which formulate the "urban and rural residents’ basic pension insurance regulations". From regulating the scope and object, fund raising, fund management and investment operations, the fund paid treatment, fund supervision, old-aged insurance system for transferring and convergence, legal responsibilities and so on to resolve the legislative issues.
