Research On The Legal System Of Basic Pension Insurance Of China

In 2010,China had published <People's Republic of China Social Insurance Law>,which presented the basic pension insurance enters the legal track.The law has been implemented for seven years.During the seven years,China's endowment insurance system is making rapid progress.For example,employee pension insurance is in line with the pension insurance of institutions and institutions,rural residents and urban residents have the same endowment insurance,pension insurance realizes provincial coordinating,pensions achieve 14 consecutive years of growth,and so on.This article is based on the existing problems in China's basic pension insurance legal system,analyze the reasons,give some suggestions.Hope to promote the construction of endowment insurance.The main content of this article is as follows.First,summarizes views and the research status of domestic scholars to grasp the mainstream of academic researching.Second,Introduce basic pension insurance regulations,and list some laws and regulations of basic pension insurance as research foundation.Then,analyzing the existing problems of legal system of basic pension insurance of China,such as incomplete legislation,high payment rate,differences in pension benefits,judicial relief difficulties,etc.The forth chapter mainly talks about the legal system of basic pension insurance of advanced foreign countries,like Germany national pension system,Japanese pension system,Singapore's and Indian's.By reading a large amount of literature,I describe the law and development of pension system of each country,and try to illustrate enlightenment from the four countries.At last,I give some suggestions on how to build a better legal system of basic pension insurance,according to the third chapter.Formulate administrative regulations of Basic Pension Insurance,then formulate pension insurance law.Accelerate the construction of a unified central agency to realize the National Coordinating Endowment Insurance.Reduce the contribution rate and extended minimum payment period.Strengthen pension insurance fund supervision.Provide legal aid to people in need.
