Due to the influence of traditional culture, management system, etc, universities of our country show a tendency that pro executive power and thin academic power, academic freedom is difficult to have any space in the universities, it’s more difficult to grasp the right of discourse. With the gradual reform of administrative system in recent years, our country put forward the target of de-administration reform in public institutions, colleges are beginning to overcome the tendency of administration, respect academic freedom, and create a relaxed academic environment. The approval of university statutes also arise at the historic moment. Under this background, the article selects this topic, and the core content is to discuss whether the purpose of de-administration could be realized under the approving of university statutes, or what degree can achieve this purpose. Around this core content, the paper is divided into four parts:The first part,investigating the origins of university statutes through the historical process of the university, and discussing the association between the origin of university statutes and academic freedom, so as to clarify relationship of university statutes and academic freedom.The second part, discussing the relationship between the university statutes and academic freedom, on the one hand, academic freedom has general and specific effect on university statutes, on the other hand, the university statutes is the fundamental symbol of modern university system, and creating a separate space for academic freedom.The third part, analyzing the intention of constructing university statutes at the present stage from the angle of institution and promulgated university statutes. The intentions of university statutes issued by the national institution mainly include: promoting the reform of institutions, realizing the de-administration in colleges and universities; encouraging scientific research, respecting academic freedom; standarding the setting of statutes, perfecting governance structure. The intentions of promulgated university statutes mainly include: training talents, serving society; improving the ability of scientific research, advocating academic freedom.The fourth part, analyzing the issued university statutes whether have the function to realizing academic freedom. We will discuss it from four aspects: the principles of statutes, the rights of teachers and students, university governance structure.
