Part-time employment is the main form of flexible employment in our country, because of its flexible and simple features, more and more employers and workers choose this way of employment. Part-time labor, meanwhile, it has become the important means of the government promoting employment, paling an important role in alleviating employment pressure and building harmonious labor relations. However, with the further development of part-time employment system, the problem of the absence of government responsibility has become increasingly prominent, the interests of part-time workers have been repeatedly violated, Urgent, we must identify the role of government in part-time employment, analyze the lack of government responsibility for the protection of workers’ rights, Based on the current situation of china’s labor and foreign advanced experience, we can put forward the targeted measures of government responsibility to construct, in order to provide a solid government guarantee.The full text is divided into five parts. Specifically including case introduction, part-time employment theoretical overview, the absence of government responsibility and the construction of government responsibilityThe first part introduce a case, at the initiative of the government, Sinopec Shandong Branch adopted the form of part-time employment to place unemployed difficult people and achieved remarkable results. This case indicates the subject of this article.The second par introduces the definition of outside and domestic for part-time labor firs, then compares the part-time labor with full-time labor and other forms of flexible employment, finally summarizes the basic characteristics of the part-time labor. In order to make readers have an accurate and comprehensive understanding about part-time employment and pave the way for the launch of the article.The third part, author discusses the attitude of government on the part-time employment and government’s position in part-time employment. At present, the government’s attitude towards part-time employment is too flexible, overemphasizing autonomy between employers and employees, while ignoring the protection of the part-time workers, therefore, the government should be both rigid and flexible, the role of government on part-time employment should be strengthened, the government should be a good law-makers, labor watchdog, dispute mediator.The forth part, author analyzes the specific performance of government irresponsibility in part-time employment form the legislative, executive, judicial three aspects respectively, The legal system about part-time employment is not perfect, small number of existing regulations, the lack of effective oversight, as a result, the effect of implementation of regulations is greatly reduced; The labor market is not standardized, single type and poor quality of service, "black intermediary" flooding; The dispute settlement mechanism need to be improved, mediation useless, arbitration litigation, no special proceedings concerning labor disputes.The fifth part, through analyzing the absence of the government responsibility above-mentioned, I propose targeted measures to strengthen the construction of government responsibility from legislation, law enforcement, judicial three areas. These include:establish a special law for the part-time employment, meanwhile, improve and modify the existing laws and regulations reasonably; Strengthen law enforcement supervision, regulate intermediary service organizations; perfect all kinds of ways and strengthen the cohesion between different ways, construct a diversified dispute settlement mechanism.
