Research On The Dispatch Of The Legal System

Dispatch first appeared in the 1920s in the United States, growth in Europe and Japan. The early 1980s, the dispatch was introduced into China, and has developed rapidly. With the development of China’s socialist market economy, the labor market has undergone tremendous changes, the original single form of traditional labor can not meet the needs of the real economy, thus flexible labor dispatch employment forms slowly being in China widely used in many industries. This paper studies the basic theory of the dispatch, including the concept of dispatch, models, types and characteristics, the use of labor dispatch tripartite legal relationship, based on the status quo of China’s labor dispatch dispatch our legal system to analyze the problems of labor, and finally draw the world’s major developed national experiences regarding the dispatch of legislation, from the protection of the legitimate interests of dispatched workers to improve the angle of the dispatch system.Thesis is divided into four chapters altogether, the first chapter is the preface, covering topics significance, at home and abroad on the dispatch of research review, research methods and innovations; Chapter dispatch system for the study of the logical starting point, the main dispatch from relational concepts, characteristics, types and between the tripartite body to explain the theoretical basis of this research; the third chapter is the status quo of China’s labor dispatch system and the legislative status quo and problems of research, and specifically addressed overseas dispatch of related systems; chapter by drawing on foreign labor dispatch system, and thus to improve our dispatch system proposed specific legal system design.
