The labor dispatching service has evolved over the years while it encroaches upon theinterests of worker. The legislators have taken some measures to curb and normalize the labordispatching service including applying for permits before establishing the labor dispatchingservice companies, the rigorous responsibility of labor dispatching service and the ranges ofscope where allows the labor dispatch. While the inadequate system guarantee in which theliability of employers and protective actions of employees remains obscure is still in need, theexecutive powers alone cannot address the issues of labor dispatching service suffering fromalready long-term transgression in primary business. The dissertation believes that to refinethe supplementary mechanisms while properly deregulate the labor dispatching service is thevery key to tackle the quandary in labor dispatching service so as to unleash the fundamentalfunction of the market.The1st part is a brief introduction of labor dispatching service. The labor dispatchingservice differs itself from traditional employment way in the area of related3parties, theseparation of employment and use, the instability and financially dependent of the workersunder labor dispatching service. The distinctive features should be taken into considerationwhen the protective measures are introduced.The2nd part explores the certainty of existence of labor dispatching service. The labordispatching service is the result of development of job markets. This part analyzes the causesof labor dispatching service being long-term approach of job markets dilemma from theperspective of accepting unit of labor dispatching unit, job reality, the optimization of laborresources, the normalization of non-standard employment and so on.The3rd part parses the legislative values of labor dispatching service. First a conciseintroduction of the values of labor dispatching service can help us comprehend the purpose ofwriting. Also, the analysis the of the status quo of labor dispatching service providessupporting proof for what follows in the next paragraph about legislative values and solutions.The “prohibitive provisions” in the legislatures cannot achieve the intended the target.The4th part is the introduction of the attitude of legislations and trend of transformationof labor dispatching service in foreign countries, like the free-style in the US, from theprohibitions to rigorous regulation to loose regulation in Japan and Germany, the strict timeline of labor dispatch in South Korea. This part aims at reference for the legislations oflabor dispatch in our country.The5th part first states the reasons and principles for loosen control in changing labordispatching service, loosen control does not mean deregulate. Then it explained the specificmeasures to regulate the timeline and ranges of scope in labor dispatch. The specificationsinclude the general and clear norms to stipulate the employees of labor dispatch, reasonableallocation of liability in employers so as to boost the development of labor dispatchingservice.
