Problems Existing In The Legal Regulation Of Karoshi And Their Corresponding Countermeasures

Along with the development of China’s economy and the globalization of world’s economy comes the increasing diversity and complexity of the labor form. Karoshi frequently appears in newspapers. On March 12, 2015, press revealed that illegal overtime working at Fox Conn has caused death among its workers. The severe fact that workers are working at the cost of their health and even lives cause people to reflect on the phenomenon of Karoshi. It’s the necessary demand of social development of any country as well as the soul and value of Labor Law to ensure the good working conditions and stable employment of workers, to advocate ways of working that are good to workers’ physical and mental health and to respect workers’ dignity and freedom so that they can achieve decent work. Currently, China has no law addressing Karoshi, so how to reduce the occurrence of accidents and casualties in the course of socioeconomic development to get workers’ rights and interests better protected is not only an issue facing companies or the government, but also a difficult subject waiting for the scholars in the field of law to address. I propose karoshi in work-related injuries.The frequent occurrence of Karoshi has caused extremely negative social effects, which makes it urgent to regulate it on a legal basis. The thesis is organized as follows: the preface introduces to readers the research statues and social situations of Karoshi. Part One discusses the reasons of Karoshi. Part Two is dedicated to answer the question why it is necessary to put legal regulations on Karoshi. The workers’ rights and interests can be maximized only when the phenomenon of Karoshi is legally regulated. Part Three focuses on the exploration of the present legal situation of Karoshi as well as its related problems and based on it, some suggestions will be offered to improve the legal situation of Karoshi. Part Four discusses how to conduct legal regulations on Karoshi by referring to the experience of Japan, America as well the Taiwan area.
