At present, in the aspect of labor relations management, foreign companies in China are in a dilemma. In terms of salary, overtime requirements, staff status, industrial injury compensation, contract management, for Chinese employees, there are some problems; especially the problem —— the treat to Chinese employees is different from the treat to foreign ones —— causes harsh reactions of foreign firms in China. Because of the problems mentioned above, in recent years, labor disputes and staff accidents occur frequently in foreign-invested companies in China, such as the suicides and gang fights among workers at Foxconn. The root of all the problems mentioned above is that enterprises don’t deal with labor relations well. In this context, with an eye to international labor standards, targeting at foreign companies in China, it is necessary and urgent to research the related problems of labor laws and regulations of our country. The author hope to find out the reasons of the problems of labor disputes of foreign companies in China, to straighten out the path of legal governance sought by foreign-invested enterprises, by combining the international labor standards with the theory on the level of economic law, labor law, company law, taking related legal provisions of foreign countries as reference and analyzing related content of economics and enterprise management as supplement. This thesis is divided into four parts. The first chapter is the introduction part. It mainly states the research background, significance and status. The second chapter mainly analyzes the current state of labor relations of foreign firms in our country. The third chapter focuses on analysis of the mail problems existing in labor relations of foreign-funded enterprises in China. The four chapter is the most important part of this paper. It proposes in detail that our country will establish a legal system which will be consistent with the international labor standards. Meanwhile, in the fourth part,the author have done a deep research on strengthening the administrative supervision of labor department, establishing a set of dispute settlement mechanism and improving labor consciousness of Chinese employees.
