"Labor Law", the "Labor Contract Law" and other labor laws and regulations are rolled out, today’s Chinese society’s increasing emphasis on labor contracts, labor contracts, not only for labor relations to establish a decisive role, but also to determine the rights and obligations of both labor important basis.Labor contracts often involve business rules and regulations, but the relationship in our business rules and labor contracts are very vague, for the rules and regulations of the employer in the labor contract in which the status and role is ambiguous,Academic approach to this problem is not to form a consensus view, and research on this issue and more trapped in superficial position, for such problems encountered in practice can not give a clear answer, causing such problems in judicial practice very difficult to deal with.Companies have their own rules and regulations and the legal nature of the formation process, it can be seen from these two points with a labor contract, although there is a close link, but there are many differences; labor contract when the business rules as part of its content although some positive significance, but because social status, legal imperfect, employers and workers of their own problems, such as the rules and regulations also make companies produce some adverse effects when used.In dealing with the status and role of business rules in the labor contract in question should be considered in terms of meaning and affect the interests of the parties has a labor relations:the combination of China’s national conditions and national conditions continue to improve the quality of China’s relevant laws and improve legislation enhance their quality of training employer and the employee, and to the relevant foreign law and legal practice experience to absorb the essence of reference.By improving the relevant legislation and learn foreign outstanding experience, business rules to determine the status and role in the conclusion of labor contracts, both for labor and safeguard the legitimate interests of both sides, but also conducive to the judicial practice solutions for such problems, more conducive to the development of China’s labor law! In this paper, the author will combine practical work, analysis of the main problems existing in the current business rules and regulations, combined with foreign experience made suggestions on improving the law and hope for the Perfection of the Labor Legislation Militiaman. At the same time hopes to be able to make the reader a better understanding of the text, and further understanding of the rules and regulations of the employer status and role in the labor contract.
