Along with the advancement of education democratization process,appreciative education as a new education idea and method, become the mainstream of education. On the one hand, some teachers dare not discipline Students. On the other hand, corporal punishment and corporal punishment in disguised forms are still widespread and news about the teachers’ corporal punishment result the harmful effect on students from psychology and physical.According to the spirit of the 18 th conference of CPC meeting, the ministry of education puts forward to promote the building of school of lawful consciousness and ability, to change ideas, strengthen the sense of the rule of law. In this context,deeply analyze the problems existing in the implementation of the disciplinary education, discusses the important significant and value of how to standardize the implementation of education disciplinary according to law.This article discussed the educational and reasonable of education disciplinary from multiple perspectives such as philosophy, psychology and pedagogy, knew about the present situation of the implementation of education discipline in Nanchong, and analyzed the main existing problems through literature method and investigation method. For example, some teachers punish excessive, the abuse of corporal punishment or corporal punishment in disguised forms; the reasons and purposes of disciplinary are not correct; teachers implement disciplinary optionally, student to teacher punish satisfaction low, the effect is poor; part of the students and their parents agree and support teachers using corporal punishment. But on the other hand, there is a phenomenon of teacher lack of necessary education disciplinary in school.And analyzed the reasons of the problems of implementation of education disciplinary: firstly, imperfect education disciplinary related legal norms; secondly,the school regulation owe science; thirdly, poor part of the teachers’ quality;fourthly, indifferent to the legal consciousness of some students and their parents,and encourage teachers unreasonable punishment, at the same time, some parents have wrong education concepts, hinder the rational use of teachers education discipline; fifthly, there exist deviations in social public opinion direction.Finally, on this basis, put forward improvement countermeasures of the implementation of education disciplinary from three aspects: national, school and teachers. Improvement countermeasures from national level including two aspects:establish education disciplinary regulations and standards as soon as possible and guide public opinion. Improvement measures from school level including:practice scientific management and evaluation toward teachers; making school rules in democracy, and concretely introduces the contents of the "code of student conduct" in the United States and the process of building of “code of student conduct” in the Canada. Improvement countermeasures from teachers level including: correct understanding of education discipline, pay attention to cultivate students’ ability of autonomous management, pay attention to students’ psychological health education, the rule of law education and strengthen the communication and contact with the parents of the students, in order to obtain the support and comprehension of parents, etc.
