On November 22,2019,China's ministry of education published the "Rules for the implementation of educational punishment by primary and secondary school teachers(draft for comments)",it shows that the professionalization of teachers' educational disciplinary power has been improved.However,after making a general survey of the legal and normative documents on teachers' disciplinary rights in primary and secondary schools,there are still some problems such as the lack of detailed regulations and the effectiveness of application between different levels of legal and normative documents.This paper clarifies the basis of primary and secondary school teachers' disciplinary power through the existing regulations on disciplinary power and theoretical research on disciplinary power,and analyzes the necessity of teacher education disciplinary,providing theoretical guidance for the implementation of teacher education disciplinary and the establishment of disciplinary system.The difficulties in the implementation of teachers' disciplinary power in primary and secondary schools in China are mainly manifested in the lack of teachers' disciplinary power,abuse of disciplinary methods,anomie of disciplinary procedures,students' conflict with disciplinary and conflicts between parents and teachers' disciplinary views.After making analysis of the cause of the above difficulties,the causes mainly include the following aspects: First,the lack of disciplinary legislation and procedural regulations;The second is the lack of disciplinary awareness of school management and the dislocation of teachers' disciplinary views;The third is the asymmetry of students' cognition and information and the weakening of parents' view of discipline.In view of the above problems,the proposed solutions include:establishing and improving the teacher disciplinary system,including the subject,object,method,content construction of the venue,and the perfection of disciplinary decision,relief and supervision procedures;Through the unification of national laws and regulations,refinement of local disciplinary mechanisms,construction of campus regulations to improve the protection of the disciplinary system;In the concrete implementation process,schools and teachers should change their disciplinary concepts,teachers should exercise their disciplinary powers reasonably,and grasp the principles and boundaries of discipline.Students should improve their moral awareness and awareness of the rule of law.Schools and parents should strengthenhome-school cooperation.Parents need to change their disciplinary concepts.
