On May 1,1950,The CCP issued the first formal law after the founding of the Republic of China. It was surprising that the first law neither penal law, nor the civil law or other common law, it is the Marriage Law of the PRC, which reflected the considerations of times by the new regime. They had showed unusual sense of urgency.The authority gave their explanation about the basic spirit of marriage law: against the traditional feudal marriage, patriarch domination, compulsory marriage, arranged marriage, mercenary marriage, polygamy and fight for women’s liberation. Denial of oppression of women’s social reality, the principle of equality between men and women and freedom of marriage of spirit of modern civilization, which make the "marriage law" to outshine the light of morality. The Women’s liberation is the main melody of marriage law, the women liberated from the feudalism marriage system. Its main purpose is to let them take part in the "construction of the socialist society".The purpose of this text lies in how does the marriage law carry out in the country. This paper introduces the basic situation in Fujian Jinjiang County, on the basis of first revealed in the county to implement "marriage law" the special difficulties encountered. The key problem is how to treat her husband in the Southeast Asia and lengthy separation "left-behind women"——Overseas Chinese women. On the one hand, the local government to "liberate" the Overseas Chinese women, let them join the fields and take part in labor so as to produce more agricultural products, supplied to non-agricultural population countries. On the other hand, women don’t really fully realize the freedom of marriage, from the Overseas Chinese family, because that would lead to a new regime of much-needed remittances shrank and coupled with the special international and domestic political environment at that time. Local government is at risk. However. For Overseas Chinese women "liberated" or not "free"?, which becomes a very tangled problem.So, how did the CCP finally deal with this dilemma? This article caught two major problems including the Overseas Chinese women’s adultery and divorce, and try to find a specific interpretation. This paper tries to present the settlement of the Overseas Chinese marriage problem under the new regime in order to render all the prospects about the process of the state intervention in the family.
