On Government Regulation Of Labor Dispatch

Along with the further reform and opening to the outside world, the role of the market mechanism has been enhanced. China’s labor and employment mode, with the great changes of society, is also in constant change. Labor dispatch came into the transition of labor and employment mode, and is the development of it. After the implementation of the "labor contract law" in 2008, labor dispatch has obtained a clear legal recognition. To be practical and realistic, dispatch has so many advantages like easing the enterprise recruitment difficulty, reducing the cost of human resources, improving the allocation efficiency of labor resources that the scale of it has expanded a lot. We can see the figures of the dispatched workers in all walks of life.While we should also see that as prescribed by law is not perfect and the government regulation is not in place. In the "blowout" situation of the development of labor dispatch, it also contains lots of problems, such as the abuse of labor dispatch, unclear liquidity position, unequal pay for equal work, relocation etc. All these above seriously infringe upon the legitimate rights and interests of workers, and also disrupt the normal order of human resources market.In the developing process of the labor dispatch, the shortcomings of itself illustrates that market mechanism, in a certain extent, is not functioning. In order to avoid this failure, the government must do something to regulate labor dispatch. It contributes to solve the problems in the development of labor dispatch, to promote the healthy development of the industry, to maintain the legitimate rights and interests of the dispatched workers and the normal order of the human resource market.Based on the basic theory of labor dispatch and the concept of government regulation, taking the development of labor dispatch in Wuxi as an example, this paper will describe the status quo of the regulation of Wuxi’s labor dispatch industry, and introduce the way to supervise labor dispatch in foreign countries. The advanced experience of government regulation in western counties will be borrowed. By contrasts, we can find out the problems existing in the government regulation of our country and the feasible measures and recommendations to improve the control in order to promote China’s labor dispatch industry norms and orderly development.
