Since the end of the twentieth century,the continuous development of China's reform and opening up,the deepening of the market economy,the interests of all parties in society,the conflict highlighted and intensified.Labor relations,as one of the most important legal relations in society,has always been the focus of attention of all walks of life,and all kinds of labor laws regulating labor relations have been controversial since they were promulgated.In the face of increasingly complex social environment and labor relations,the labor legal system needs to be improved and adjusted to meet the needs of social development and the demands of the main interests.At present,with the Labor Law as the core,China has formed a labor law system consisting of Labor Contract Law,Labor Dispute Mediation and Arbitration Law,Employment Promotion Law and other important laws and regulations.The promulgation and implementation of these laws and regulations have played a great role in the adjustment of labor legal relations and the protection of worker's legal rights from different fields and angles.However,it is undeniable that some of these laws and regulations are controversial both in the process of legislation and in the actual operation,and need to be further refined and improved to adapt to the coordinated development of other links in the construction of the rule of law.Labor dispatch is a new type of employment mode with rapid development.It has positive social practical significance such as promoting employment and reducing the cost of employment.However,due to its complexity of its own characteristics,it has also become a means for some enterprises to evade legal responsibilities.It is necessary to improve the labor legal system in China.Next,we should improve and perfect the labor dispatching system so as to give full play to its positive and positive role.This paper starts with the introduction,points out the problems existing in the practice of the current regulations of labor dispatch through a judicial case,and leads to the purpose of this study-to seek the perfect path of the system of labor dispatch in China.After that,this paper makes a thorough study and Discussion on the legal relationship of labor dispatch.Firstly,it discusses the concept,type and nature of the legal relationship of the labor dispatch system,and the main content of the labor dispatch system stipulated by law.After having a detailed understanding of the basic characteristics of labor dispatch,this paper analyses the defects of the current labor dispatch system in China from the following aspects: unclear scope of application of labor dispatch,imperfect supervision system for labor dispatch parties,and imperfect guarantee mechanism for labor dispatch rights.Finally,in view of the above problems,we put forward solutions and perfect ideas one by one.Perfecting the relevant laws and regulations of labor dispatch and effective regulation of labor dispatch industry can better play the positive role of labor dispatch in promoting social employment and promote the healthy and stable development of our society.
