| Currently,the labor dispatch is a new employment mode in our country,which with follows advantages:greatly reduces the labor cost,specialized agencies providing industry chain management,flexible and convenient employment;but it also facing many issue.In the legislative process,China has amended the content of labor dispatch in" Labor Contract Law",also introduced“Interim Regulations of Labor Dispatch "and other relevant laws and regulations,,but still unable to deal with practical issue.As issue has been accumulated,it has intensified the contradiction among the main body of labor dispatching,causing series social problems and public crisis.Government legislation is certainly its own duty,but the key is how the government applies laws and policies,and guides the other three parties to supervise and manage the labor dispatch industry.In this paper,the government regulations of labor dispatching as the research object,with the points of view of government and public management theory,combined with dispatching employment situation of G bank in Nanning branch,Guangxi,finds out the existing issue from several aspects:dispatching units management chaos,abuse of worker in unites assigned by labor dispatching,mutual blame mistakes of staffing firms and accepting units,unequal treatment of labor dispatching work and qualifications,the right without maintenance of labor dispatching work and little development space,realize by analysis the root lies on underdevelopment of legislative regulation,lack of supervision and guiding on supervision and management system,absent of a sound social security system,lack of third party remedy mechanism,etc.points out the deficiency of the legislative and management by government,at the same time,applying the theory of government functions,public governance theory,coordination theory,and draw lessons from foreign significantly effective measures,put forward the collaborative governance,build a dispatching system,such as perfect market access mechanism of dispatching units,clear the duration of the labor dispatch,the applicable scope and industry restrictions,clear division of the legal responsibility among the labor dispatch units and employment units,improvement the system of equal pay for equal work and equal treatment for labor dispatch workers,establish the government regulation system,establishing perfect social security mechanism,improve the system of media supervision and industry and trade union rights protection measures,and realize the multi-agent governance,develop a complete set of system and measures,provides a new thought for the government regulating labor dispatching,in addition,the labor dispatching industry has the greatest benefit in China,and it has also played a role in alleviating labor conflicts and promoting social stability. |
