There is a group of people named migrant workers that wecan’t ignore,they make a great contribution to the economic development of our country.Since the1980s, with the reform of state-owned enterprise employment system, as well asthe found of foreign-funded enterprises and private enterprises, the development of townshipenterprises, and the steady development of urbanization, prompted farmers become migrantworkers, changed agricultural labor force into non-agricultural labor force in the process ofthe business, to become the army of industrial workers.Especially in the dirty, tired and badline positions, enterprises like to offer temporary jobs for migrant workers. However theylack the labor protection knowledge and the risk protection consciousness,their laborintensity is big, working time is long, which increases their risk of suffering fromoccupational diseases. In view of the occupational disease has some special properties,suchas complex causes, a long incubation period, damaging to the body with accumulated andpersistent, so migrant workers are difficult to discover and cure occupational disease in time.In addition, they have less wage income, less social security, less legal knowledge, these allmore reduced their ability of cognitive and defense occupational disease; The labor relationsof migrant workers are not fixed, which hinder the way of their rights. Most migrant workersare the main labor in their families, and the treatment cycle of occupational disease needseveral years, the cost of treatment is also a large number,all of these have seriously affectedthe normal life of migrant workers’ families.Nowadays, China is in a critical period of market transition, in the period of transition, manysocial problems emerge in endlessly. Coupled with the financial crisis make the labor marketsupply exceeds demand, the weak position of workers is obvious, self-protectionconsciousness, the imperfection of social system, resulting in the increasing of frequency ofoccupational disease risk, the increasing of incidence of migrant workers and the increasingof social influence, making it become one of the very serious social problem that theoccupational disease risk of migrant workers in the process of urbanization. Under thebackground of urbanization, based on the double particularity of migrant workers andoccupational disease risk, this article in view of the current occupational disease risks facedby migrant workers and much-needed security problems in the process of our urbanization,from the perspective of law, social security, employers liability insurance and so on to analyze problems, and to study and put forward the corresponding improvement suggestions.
