The Study On Rural Land Expropriation Disputes

With the accelerating process of urbanization in our country, a large numberrural land is expropriated. More and more rural land disputes happen frequently，bringing about the negative effete for harmonious society. Therefore the question asactively studying on what causes rural land disputes and how to reduce rural landdisputes, have become the urgent ones for Chinese government to solve.This Paper firstly elaborates the basic theory of the rural land expropriationdispute and its basic characteristics, and combines rural land expropriation of N city hnew area in Jiangxi province which reveals the disputes continuously. Secondly，through the questionnaire survey and interview, it is concluded that the main reasonsfor the land disputes are land expropriation procedures unreasonable, the lowcompensation standard, the imperfect villagers autonomy system, at the same time,landless peasants could not choose right dispute resolution mechanism as itscomplexity and behind-time. Finally this paper proposes the measure for reducingrural land conflicts from the angle of economic, system, law and administration. Inthe economic aspects, we should improve the land acquisition standard and establishthe land compensation fees deposit account. In the system aspects, we should perfectvillager self-governance system and rural social security system. In the legal aspects,we should enforce the relevant laws and regulations strictly and further perfect relatedlaws and regulations of rural land expropriation. In the administration aspects, weshould perfect the leading cadres check mechanism, establish the diverse mechanismof solving disputes and improve the quality of village cadres.
