Study On The Dispute Resolution Of Rural Land Expropriation From The Perspective Of Government Act

With the rapid development of China's social economy and the acceleration of the urbanization process,In the expansion of urban construction,a large number of rural land is expropriated.However,the current rule-making,administrative approval and plan implementation of land expropriation led by the government is irrational,which is bad for the relationship between government and the land-lost farmers.The disputes happens a lot,even come into violent conflict.It does harm to social stability and economy development.As the leader of rural land expropriation,the government plays a crucial role in implementing National Policy,local economy development and protecting farmers'interests.Therefore,it's important and significant to study on rural land expropriation,including its current situation,causes and countermeasure,from the perspective of Government Act.This paper is divided into five parts.First part introduces the research background,significance,research ideas,the problem to be solved and the innovations.Second part introduces the related concepts and the theoretical basis of rural land expropriation dispute,including the conditions of land expropriation,procedures,the rights and responsibilities of government.Third part analyzes the main forms of rural land expropriation disputes,based on the case of Sanyuan district of Sanming City.Fourth part analyzes the causes of rural land expropriation disputes from the perspective of government,which study on the aspects of policy and regulation management,administrative management and the implementation of land expropriation,To sum up the Government Act factors in land expropriation disputes.Fifth part is crucial.According to the existing problems,it puts forward some countermeasures to solve rural land expropriation disputes.The research is mainly classified from the following aspects:First,strengthen legal publicity,enhance the feasibility of land expropriation policy,and constantly improve the land compensation system and resettlement plan;The second is to improve the sense of responsibility for personal quality,and improving and standardizing the administrative examination and approval management of government departments,in order to reduce land expropriation dispute which is caused by the administrative negligence.Third,it needs to implement information disclosure,establish a safeguard mechanism,and ensure that the land expropriation is organized and implemented according to law after approval.
