The Study Of The Development Of China’s Patent Insurance

With the rapid development of economy and science and technology, knowledgeeconomy era has arrived, patents as an important intangible asset, coupled withexclusivity conferred by law, to monopolize the market for some time, gradually becomeenterprises, especially high-tech companies core competitiveness, has been rapid growth.In this context, enterprises should strengthen patent management, make full use of thepatent system to maintain their legitimate legal rights. However, due to technical director,legal cumbersome and costly and time-consuming, most companies, especially SMEsencounter in patent litigation are overwhelmed. In order to spread the risks and costs oflitigation of patent infringement, should establish an effective mechanism to deal withrisk management and legal risk aversion, while the patent is precisely the insurance canhelp companies manage and avoid legal risks largely consists mainly of patentinfringement patent enforcement insurance and liability insurance. This has beenrelatively good in the United States and Europe and some other developed countries,while China has just started, is gradually establish and improve patent insurance.Foshan Chancheng initiatively studying with the world, the government, businessesand insurance companies, as a "Trinity" cooperative model patents, pioneered patentenforcement insurance in our country. In order to encourage enterprises to participate inthe government insurance and the insurance companies active in the business, specialfunds for the development of patent insurance are provided, to reduce the premium.Patent cooperative insurance model patent has advantages and disadvantages, which isthe reason for this article to explore patent insurance.In this paper, in the form of case studies, is divided into five partss, each specificcontent part as follows:The first part, mainly talk the background and other basic situations of patentinsurance.The second part, from Chancheng patent insurance model, product and marketsuccess three aspects to analysis Chancheng patent patent insurance cooperatives, andother areas to be analyzed and improved，and use the SWOT analysis methods toComparative analysis. The third chapter, focuses on our patent insurance development,and case analysis to identify the strengths and weaknesses of the insurance development of China’s patent. The fourth chapter, briefly introduces the development status of theU.S. and Europe, and other countries patent insurance, and comparative analysis, drawinspiration development of our patent coverage. The fifth chapter, by the above analysis,combined with China’s specific situation, put forward to improve our patent insurancerecommendations.
