| Labor standars work is an important part of labor and social security work.Reasonable labor standards is advantageous to protect the rights and interests of thebroad masses of workers and promote the harmonious development of labor relations.From human rights theory, corporate social responsibility theory,"race to the bottom"theory, comparative advantage theory and the theory of labor relations, enterpriselabor standards has the self-consistent logic basis. In this paper, centering round fourbasic key elements of international core labor standard: the right to freedom ofassociation and collective bargaining, employment discrimination, forced labor andchild labor, the comparative study is conducted between the common enterprise laborstandards in the world and Chinese labor standards. It is found that there is someregularities in these standards. Labor standards in our country has made great progress,but by comparing it is found that labour standards in China are more stringent onrestriction of organising trade union, the guarantee of the collective bargaining rightsis not sufficient, the scope of employment discrimination and forced labor is relativelynarrowly considered, and flexibility and adaptability of child labor standards isinsufficient. In the future, our country should strengthen the construction of tradeunion, set up the multilevel collective bargaining system, explicit the legalresponsibility of enterprizses to refuse collective bargaining in order to guarantee thefreedom of association and collective bargaining. By expanding the scope ofprotection of the employment discrimination, expliciting the judgment standard ofemployment discrimination and establishing the litigation proof inversion principle, itis achieved to prohibt employment discrimination. Forced labor will be hit bytruncating input path of forced labor, expanding form and applicable scope of forcedlabor. By establishing extensive childhood labor standards, strengthening enterprise’ssocial responsibility in protecting child labor, eliminating poverty etc., phenomenonof child labor will be reduced and labor rights will be protected. |
