Research On The Sustainable Protection Mechanism Of Land Rights And Interests For Landless Peasants

Rural urbanization is one of the most important issues in our country nowadays, but italso inevitably driving the land into non-agriculture. In rural areas, land is as the mostimportant factor of production and related to the survival and long-term livelihood offarmers. The fact that under the low lever of Social Security system, the rapid progress ofurbanization makes many farmers lost their land and it can not get farmers the urbanidentity. The cost of living leading to breed discontent and implement farmland conflicts.In the time of institutional transformation and social transformation process, noappropriately protecting the interests of farmers’ land will make difficulties to promoteindustrialization and urbanization and there is no guarantee for social stability. December2013, the central work conference on urbanization made it clear that solving the problemof farmers is the key to promoting good new urbanization.Based on the concerns of the current farmland conflicts, the study focuses on the wayto protect farmers’ land rights in the process of urbanization. Logically, this paper reviewsthe current literature studied this issue and the cases that running effectively to protect theinterests of farmers’ land from domestic and international experience, so as to provide areference for the design of mechanisms to protect our rights and interests of landlesspeasants. Secondly, based on the field survey data in G Zone, specifically pictures thedamaged interests of landless peasants, including low land compensation standards, lowresettlement compensation standard, ignoring the homestead property interest, lowproportion of the actual allocation, no more money to long-term investment, difficult tokeep cross-protection livelihood, poor housing conditions. Thirdly, using the method ofsystem analysis, explains the causes of the damage of i landless peasants’ land interestsand rights, including unreasonable compensation system, land property rights system,local governance system, land distribution system, land inheritance system. Finally, on thebasis of empirical data and in-depth analysis on the combination of domestic andinternational experience, designs mechanisms to protect farmers’ rights and interests,including a clear stipulation in the content of the peasants’ rights and interests, exploringrevenue sharing formula rights protection mechanisms, defining role of the localgovernment, lock the interests of village, enhance farmers’ bargaining power, etc., so as togiving reference recommendations to promote the sustainable development of China’surbanization.
