The commercial house pre-sale mode, with its advantages of rapidly raising funds, transferring risk, has been widely used. And it’s also popular with property buyers because of the great purchase discount.However, because its own characteristics of options trading and relevant supporting regulatory system are imperfect, there is big risk in pre-sale transactions. Checking evidence of both parties at court case arising from the commercial house selling in advance disputes emerge in an endless stream of life. Along with the gradual development of urban transformation, a lot of farmers join in the team of buyers, adding new risk for the pre-sale transactions, which is a new discovery of the pre-sale of commercial housing transaction risk. Also, the country pay more attention to the problems of sale transactions. In 2014, the new introduction of the "pre-sale contracts for commercial housing"(model version), an increase of the new special supervision of pre-sale funds and the maintenance of the buyer in terms of housing quality inspection requirements, but because of the lack of supporting measures to put in place, it became difficult to play a substantive role in practice.This paper used the combination research methods of literature analysis and empirical research. Meanwhile, studying lots of literature, obtaining part of case date from the court, using statistical analysis to summarize some glaring examples of transaction risk, using the descriptive to study profound research and summarize the existing defects of the commercial house selling in advance model system. Proposed the establishment of a pre-sale financial supervision and the specific ways to implement the registration and enforcement of such measures, and proposed the establishment of the insurance mechanism. We can try to implement the rural land mortgage loans, raising the purchasing power of the population, in order to form a good role to avoid the sale transaction risk. These the results are creative. I hope our continued commitment to the perfection of the system and the introduction of effective protection mechanism, so as to give customers better, reduce transaction risk, maintain the stability of the real estate market.
