At present, the Pre-sale plays an important role in real estate sales. While during the past 20 years’ rapid growth of real estate market in Mainland China, pre-sale experienced a variety of problems. Countless of transaction issues, problems in financial regulators, protection of the rights and interests of the buyers,and financial risk control expose more and more troubles. Then reform and improvement the existing real estate pre-sale system is urgently needed.Since the 60’s of the last century, pre-sale of real estate had been very prevalent in Taiwan, and the relevant laws, regulations and policy has been more robust now. So it is significant to analysis the comparison between pre-sale in Taiwan and Mainland China for the reform and improvement of the current real estate pre-sale system in Mainland China.Firstly, the paper summarizes the characteristics and nature of the pre-sale system in Taiwan and the mainland, also its course of development was also introduced. Then the processes of real estate pre-sale was thoroughly compared between Taiwan and mainland in many aspects, such as pre-sale access conditions,the pre-sale contract content, the way of booking payment, pre-sale funds supervision mechanism, the pre-sale of commercial housing construction and management mechanism, the sale of commercial housing assignment mechanism and so on.Point out Compared with the mainland, the main difference in Taiwan commercial housing pre-sale system is the depth participation of construction manager company. Taiwan Real Estate Management System as the third party in pre-sale system has no direct interest relations with other participants, its involvement in the entire pre-sale process,strengthen each participate in the exchange of information directly, balance the parties share the risk the real estate developers pre-sale regulation.House pre-sale assurance system in Taiwan is based on the performance of Real Estate Management System. In this paper,focusing on the Taiwan Real Estate Management System as research object, describing the origin and development of the Real Estate Management System,in terms of the performance management, contract verification, construction financing, and other aspects analyze its function orientation.Aiming at the key problem in the mainland commercial housing pre-sale system, in the view of property buyers, developers and the lending bank of Taiwan building manager system, to perfect the system of commercial housing pre-sale reference value were discussed in this paper, points out the necessity of the mainland will introduce a system of construction manager and difficulty facing.The paper finally points out further source of difference between Mainland China and Taiwan real estate pre-sale system is mainly embodied in the risk management,finds some defects in real estate pre-sale risk management and control.Presents important enlightenment for the mainland to reform and perfect current pre-sale system from Taiwan trading system, and puts forward some corresponding suggestions on the future research direction.
