China is a political theory country that based on traditional agricultural as economic foundation, advocating people-oriented and moral. Agriculture is the economic lifeblood of our national tradition,it is the land problems that cracks " Three Rural Issues" problem?s key elements. With the development of China’s industrialization, informatization, urbanization and agricultural modernization, A large number of rural labor move to cities, the level of agricultural technology and equipments continue to improve, farmers will be change the planting rights to others farmer, the same village or others villages. This phenomenon is more and more common. Therefore, nowadays, the land contracted management rights transfer become more quickly. To development modern agriculture has become necessary. As the " Decision" of the Third Plenary Session of 18 th points, farmers have the right to contracted management of land mortgages and guarantee power. Then in the First files of 2014, the government allow the financial institutions for mortgage land contract management rights. In this background, it is an important thing how to carry out the new model mortgage of the land contract management rights.The main contents of this paper is the study of the land contract and management rights at home and abroad to carry out mortgage lending model analysis and risk prevention now proceed to study the relevant issues at home and abroad for its countermeasure system, the basic theory, discusses the present stage of our land achievements in mortgage financing flaws and innovation.According to the search stage of the practice of land contract and management rights, the research of risk still purely rely on the legislation issued before, which means this research might relate to the sporadic research. This, in turn, causes the inadequate research.This paper begins with the constactural rights of land contract focusing on the risks and difficulties which occoured in the experiment at this stage and comes up with some constructive advices. This paper is divided into six chapters:The second part of the theory of knowledge. The main point is how to define and discuss the problem of ecomony and laws in terms of the contracted management of rural land. And analysis different kids of mortage loans of contracted management of rural land in different bussiness entitiesThe third section involves the following aspects: 1)the analyze of the issues relating to current land contract and management rights issued by China, 2)the main factor of mortgages due to the legislation on inappropriate land contract and management, 3)the lack of market mechanism and social security system.The fourth part is empirical research. Mainly through the investigation Buddha residents Tianmen Mountain and shihe two towns by Logistic model to analyze the main factors that whether influence farmers to mortgage agricultural land contract and management rights are: age, occupation, household income, household the size and scale of arable land.The fifth part is in the process of implementation of land contractual management right mortgage and risk has occurred or is about to occur, from three aspects: the legal, social and economic levels to develop appropriate preventive and improvement measures.
